France: An Afghan refuses to leave a flat he has unlawfully occupied, the state is powerless

The prefecture of Vendée demanded his immediate expulsion, the judge for administrative injunctions of the administrative court of Nantes ordered him this week to “immediately” vacate the flat he occupies, but the 40-year-old Afghan citizen is not moving. An example of the powerlessness of the state: a foreigner can simply override the administrative machinery and decide to occupy a flat to which he has no rights if he wants to!

This week’s judgement is just the latest climax in a legal dispute between an Afghan citizen, the state and the Vista association that is housing him. The problem: the man has made himself comfortable and keeps appealing. In June 2023, he was granted subsidiary protection as he was not entitled to refugee status. In July 2023, the French Office for Immigration and Integration (OFII) informed him that he had to leave his home and move to a temporary centre. The man had refused! On October 27, the Prefect of the Vendée himself ordered him to vacate the premises within 15 days: another refusal! And the state is reluctant to use force, as the “associations” and the do-gooders would see this as malicious.

The worst thing is that his vacant accommodation is not given to French people, but to other immigrants waiting for accommodation. In the Vendée department, no fewer than 82 “asylum seekers” and their families are waiting for accommodation generously paid for by the French.

If he is deported, let’s hope that this Afghan, in order to get rid of his anger, does not decide to “punish” French people in one way or another…
