German court forbids a woman to put up a cross in her garden

A pensioner from Düsseldorf must remove a wooden cross in her garden that is about seven metres high. This was the decision of the Düsseldorf Regional Court. It thus confirmed the first-instance ruling of the district court.

The pensioner had had the cross erected in the garden of the house in which she owns a condominium. The owner of another flat felt disturbed by it. In a press release, the district court stated that the massive height of the cross was already a visual disturbance to the residential complex. To a reasonable observer it would look like a disturbing foreign body. The result is that the garden loses its appearance as a garden in large parts and takes on more the features of a memorial. The judgement is final.
