Jail for the Afghan girl rapist from Dortmund’s Nordstadt district !
On Thursday, the judges sentenced the asylum seeker Zubyr S. (24) to prison for five years. His case had horrified the whole of Germany in 2020. At that time, it had become known that the drug dealer had been released after the alleged rape of a child (11) – and shortly afterwards assaulted a girl (13) in the bicycle cellar.
However, the verdict only dealt with the second assault – the first case had been separated because the victim only appeared once for the trial and has not been located since. According to the newspaper BILD, the girl lives in completely desolate conditions.
However, the criminal court found the statements of the 13-year-old absolutely credible. Judge Ulf Pennig (60): “The accused lured N. into the bicycle room under a pretext with the intention of performing sexual acts on her. He was aware that she was only 13 years old.” The outward impression of the witness was “undoubtedly that of a sexually inexperienced child”.
However, it had not been possible to establish beyond doubt that Zubyr S. really noticed the girl’s resistance. “It could have been noticed if the accused had paid attention. It remains a significant assault,” said the chairman.
For this, the son of a cloth merchant was given a sentence of four years. One year was also given for the possession of 142.2 grammes of marijuana. And: should the first victim reappear, he would face an additional prison sentence.
With their verdict, the judges followed the prosecutor’s request. The defence lawyers, Dieter Axmann (56) and Christian Kucera (52) had demanded an acquittal. They criticised the “suggestive questioning of the witness at the police station” and believed the client that the basement sex happened voluntarily. “This assumption is – to put it mildly – completely unrealistic,” Pennig said.
