October 5, 2021, scene of the crime, hospital in the Porz district of Cologne, surgical ward. When nurse Melanie S. (37, name altered) has finished work and goes into the changing room, the male nurse is already waiting for her there: according to the indictment, with his trousers down and masturbating.
When she put on leggings and a jumper, he allegedly walked up to her and grabbed her. He then allegedly touched his shocked victim vaginally with his finger and rubbed his penis against her buttocks. With the words, “Be quiet, be quiet, I have pressure.”
The accused (was dismissed without notice) makes a statement via his defence lawyer. This had not happened against her will. Moreover, she had told him that she was a member of “Joyclub” – an erotic portal – and that she had shown him lingerie photos.
But when it is the victim’s turn to report, there is only silence and shock in the courtroom: “I said NO and called for help.”
The woman goes on to report, “I’ve been on sick leave since the incident, I don’t go anywhere without my significant other and I get sweats and panic attacks when strange men approach me.”
The victim reports that after the crime, the accused even followed her into the car park: “He said to me: ‘No one is waiting for you at home anyway. Tomorrow I’ll see you again in the changing room’.”
Sentence: 1 year and 6 months suspended prison sentence plus 1000 euros compensation for pain and suffering.
